1. Definitions

In these general terms and conditions, the following terms are used with the meanings below, unless expressly indicated otherwise or unless the context indicates otherwise.

• SMS Messages: a company operated by Agência Target Virtual, headquartered in Brazil, registered under CNPJ number 44.670.718/0001-6.
• User: the individual using the website.
• Agreement: the agreement established through the website between the user and SMS Messages.
• Service: the service that the user can use through the website.
• Website: the website where the user can send a text message for a fee.

2. General

These general terms and conditions apply to the use of the website and to any agreement between SMS Messages and the user to whom these general terms apply.

Any deviations from these general terms and conditions will only be valid if expressly agreed in writing or by email.

3. Contact Details

Contact can be made at any time by email at [email protected]. SMS Messages strives to respond within 48 hours.

4. Use of the Service

The contract is concluded by the user's use of the service.

If the user is under 18 years of age, the user must have authorization from a parent or legal guardian to use the service.

The user composes their own SMS text, enters a recipient phone number and can verify the entered data before choosing the payment method.

After payment is completed, the SMS is sent to the recipient. Messages are one-way, meaning the recipient cannot reply to the SMS message.

SMS Messages cannot guarantee the arrival of an SMS message. Text messages may not arrive due to causes beyond its control. If the user proves that a text message did not arrive, the user may be reasonably compensated, up to a maximum of 50% of the amount paid.

5. Right of Withdrawal

The user agrees that performance of the contract begins immediately upon conclusion of the contract. Therefore, the user cannot invoke the right of withdrawal.

6. Rates and Fees

All published rates for the service already include fees.

SMS Messages reserves the right to change its rates from time to time without prior notice.

7. User Obligations

The user must not use the service for any act that:

• is contrary to national or international law, including discriminatory, abusive, threatening, misleading or racist text messages, spam, or sending multiple messages to the same person.
• violates good morals.
• violates the rights of third parties.
• constitutes harassment, intimidation or irresponsible use.

SMS Messages is not responsible for damages arising from the use of this service. In case of abuse, sender and payer data may be handed over to authorities upon legally valid request.

By ordering an SMS to be sent, the user declares that there is no violation of legal provisions or protected rights of third parties and indemnifies SMS Messages against third-party claims and related damages.

8. Complaints

Complaints or suggestions about the service can be reported by email at [email protected].

Complaints will be handled within 30 days. If a complaint cannot be resolved within 30 days, the user will be informed of the delay period.

9. Payment and Message Processing

To use the service, the user pays through the available payment methods, such as credit card, Google Pay or Apple Pay, when available. Messages are sent automatically after payment confirmation. This service is available 24/7.
