General Terms and Conditions for Sending Anonymous SMS
1. Definitions.
1.1. In these general terms and conditions, the following terms are used with the following meaning, unless expressly indicated otherwise or unless otherwise indicated in the context:
A - SMS Messages: a company operated by Agência Target Virtual, headquartered in Brazil, registered under CNPJ number 44.670.718/0001-6;
B - User: the individual using the website;
C - Agreement: the agreement established through the website between the user and SMS Messages;
D - Service: the service that the user can use through the website;
E - Website: the website smsmensagens.com.br/anonymous-sms.html where the user can send a text message for a fee;
2. General
2.1. These general terms and conditions apply to the use of the website and to any agreement between SMS Mensagens and the user to whom SMS Mensagens has declared these general terms applicable.
2.2. Any deviations from these general terms and conditions will only be valid if expressly agreed in writing or by email.
3. Contact Details
3.1. Contact can be made at any time by email at [email protected]. SMS Mensagens strives to respond within 48 hours.
4. Use of the Service
4.1 The contract is concluded by the user's use of the service.
4.2 If the user is under 18 years of age, the user must have authorization from their parent or guardian to use the service.
4.3 The user composes their own SMS text. The user enters a phone number as the recipient. In the next step, the user can verify the entered data and choose the payment method.
4.4 After the SMS payment is completed, the SMS is sent to the recipient.
4.5 Our messages are one-way, meaning the recipient cannot reply to the SMS message.
4.6 SMS Mensagens cannot guarantee the arrival of an SMS message. Text messages may not arrive due to causes beyond its control. If the user can prove that a text message did not arrive, the user will be reasonably compensated, up to a maximum of 50% of the amount paid.
5. Right of Withdrawal
5.1 The user agrees that performance of the contract will begin immediately upon conclusion of the contract. Therefore, the user cannot invoke the right of withdrawal.
6. Rates and Fees
6.1 All published rates for the service already include fees.
6.2 SMS Messages reserves the right to change its rates from time to time without prior notice.
7. User Obligations.
7.1 The user must not engage in any acts using the service that:
A - are contrary to national or international law, such as, but certainly not limited to, sending discriminatory, abusive, threatening, misleading, racist text messages, spam, or sending multiple text messages to the same person (stalking);
B - violate good morals;
C - violate the rights of third parties;
D - are sexually or ethically harassing irresponsible;
7.2 SMS Mensagens is not responsible for any type of damage arising from the use of this service. In case of abuse, all sender and payer data will be handed over to the authorities upon legally valid request.
7.3 By ordering an SMS to be sent, the user declares that there is no violation of legal provisions and/or protected rights of third parties and INDEMNIFIES SMS Mensagens for third-party claims and for direct and indirect damages, both financial and any other consequences, resulting from the sending of the SMS.
8. Complaints
8.1 Complaints or suggestions about our service can be reported to SMS Mensagens via email at [email protected]
8.2 Complaints will be handled by SMS Mensagens within 30 days. If a complaint cannot be resolved within 30 days, the user will be informed of the delay period.
9. Payment and Message Processing
9.1 To use the service, the user will pay by credit card, Google Pay and Apple Pay, and messages will be sent automatically after payment. This service is available 24/7.
